Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of these Terms and Conditions:

Application means the software program provided by SAFF downloaded by You on any electronic device, named SAFF+

Application Store means the digital distribution service operated and developed by Apple Inc. (Apple App Store) or Google Inc. (Google Play Store) in which the Application has been downloaded.

Affiliate means an entity that controls, is controlled by or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.

Country refers to: The Kingdom of Saudi Arabia (KSA)

SAFF (referred to as either "We", "Us" or "Our" in this Agreement) refers to Saudi Football Federation, King Abdulaziz Rd, Alyasmin, Riyadh 11564.

Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.

Service refers to the Application or the Website or both and their content.

Terms and Conditions (also referred as "Terms") mean these Terms and Conditions that form the entire agreement between You and SAFF regarding the use of the Service. This Terms set forth the terms and conditions that regulate the relationship SAFF and users of the Service ("User", "Users", "You").

Third-party Services means any services or content (including data, information, products or services) provided by a third-party that may be displayed, included or made available by the Service.

Website refers to SAFF PLUS, accessible from www.saffplus.sa

You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Acknowledgment

These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and SAFF. These Terms and Conditions set out the rights and obligations of all Users regarding the use of the Service.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, Users and others who access or use the Service.

By accessing or using the Service You agree to be bound by these Terms and Conditions as well as any other communication, warning and other legal notices that may be made available to You while browsing. If You disagree with any part of these Terms and Conditions then You may not access the Service.

You represent that you are over the age of 18. SAFF does not permit those under 18 to use the Service.

Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of SAFF. Our Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your personal information when you use the Application or the Website and tells You about Your privacy rights and how the law protects You. Please read Our Privacy Policy carefully before using Our Service.

You are responsible for all activity that occurs under your account, including unauthorized activity. You must safeguard the confidentiality of your account credentials and may not share your account credentials with anyone. If you are using a computer that others have access to, You must log out of your account after each session. If you become aware of unauthorized access to your account, you must change your password and notify us immediately.

Access to the Service is the sole responsibility of You. This Service contains information. In general, the information included in the Service is for informational purposes only. Simply accessing the Service directly or through other links does not imply entering into any type of commercial relationship.

Any content viewed through the Service is for your personal and non-commercial use only.

When you are a User, we grant you a limited, non-exclusive, non-transferable, non-sublicensable licence to access the Service and view the contents on a streaming-only basis. Except for the foregoing limited licence, no right, title, or interest shall be transferred to You. You agree not to use the contents for public performances.

You undertake to use the content offered on the Service diligently, correctly and lawfully and, in particular, undertakes to refrain from (a) using the content in a manner, for purposes or with effects contrary to law, legally binding orders, morality and generally accepted good customs or public order; (b) reproducing or copying, distributing, allowing public access through any form of public communication, adapting, transforming or modifying the content, unless authorised by the owner of the corresponding rights or it is legally permitted; (c) deleting, evading or manipulating the copyright, trademarks and other identifying data.

SAFF acting under the principle of good faith, makes its best efforts to ensure that the information, content and data appearing on the Service are duly reviewed before being updated. However, despite the utmost due diligence, it is not possible to guarantee that all the information on the Service is absolutely free of errors, defects or other equivalent problems, However, SAFF will use its best effort to fix and correct any issues once being discovered by SAFF itself or reported by Users. Therefore, SAFF recommends Users to be aware of any possible updates or corrections that the Service may incorporate. In the event of any doubt or technical problem, Users are recommended to contact SAFF through the channels provided in this Terms.

In light of the above, SAFF does not authorise the reproduction, distribution and, in general, any act of public communication by any means of the transmissions or retransmissions of content in public premises including but not limited to communities, neighbourhoods, hotels, motels, premises, hospitals and clinics, retirement homes and student residences, restaurants, shopping centres, buses, trains, planes or similar means of passenger transport, websites, social media accounts or, in general, any other use not permitted in this Terms.

Therefore, in the event that a User (or any of their dependents) breaches the provisions of this condition and reproduces, distributes or publicly communicates by any means any of the audiovisual content transmitted or retransmitted by the Service, SAFF reserves the right to interrupt the service as a matter of urgency. Likewise, the User will assume, under her/hissole responsibility, the consequences, damages or actions that may arise from such acts against SAFF and/or third parties, exempting SAFF from any liability in this regard. Likewise, in the event of unauthorised or unlawful use of the Platform by the User, SAFF reserves the right to take any legal action it deems appropriate in order to seek compensation for any damages that such action may have caused.

If the User breaches this Terms, the User shall be liable to SAFF, its directors, officers, employees, Affiliates, agents, contractors and licensors with respect to any claims arising from such breach. The User shall also be liable for any action taken by SAFF in connection with the investigation of a possible breach of this Terms or as a result of SAFF's determination or conclusion that a breach of this Terms occurred.

Third-party Services Our Service may contain links to Third-Party Services that are not owned or controlled by SAFF.SAFF has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any Third-Party Services. You further acknowledge and agree that SAFF shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services. We strongly advise You to read the terms and conditions and privacy policies of any Third-party services that You visit.

Geographical Limitations of the Service and Conditions of International Use

The User is informed that some of the functionalities of the Service may not be available and/or work properly in all countries due to technical and/or legal limitations.

The Service is managed by SAFF, which operate in the Country, making the Content available within the territorial scope of the Country. Although the Service may be accessible from outside the Country, given the inherent "non-territorial" nature of Internet access, the User accepts that the Service is intended to be used primarily by users within the Country and, where appropriate, by any person or entity in any country or jurisdiction insofar as its use is not contrary to local laws or regulations in force at any given time. Therefore, if any or all of the content or elements hosted on the Service are considered illegal in other countries, access to them and their use by the User is prohibited and, in the event that this occurs, it will be exclusively under the responsibility of the User, who is obliged to comply with and observe the laws applicable to these countries. The use of the Service by the User within a specific country is at the User's own risk.

That said, certain content may not be available in all countries or territories. Certain content will be restricted to certain territories. SAFF shall not be liable at any time for any damage that may be caused to the User by this limitation of the functionalities of the Service.

Misuse of the Platform

The User undertakes to make appropriate use of the Service, and not to use it to engage in activities that are illicit or contrary to good faith and legal order; to disseminate contents or propaganda of a racist, xenophobic, pornographic or terrorist nature or that violate human rights; cause damage to the physical and computer systems of SAFF or its suppliers, introduce or disseminate computer viruses or any other physical or computer systems that are susceptible to causing the aforementioned damage.

Advertising

The User is aware and accepts that SAFF reserves the right to post advertisements; thus, advertising may appear on the Service and that, therefore, the User may access advertising from SAFF and/or third-party companies or professionals that contract with SAFF

Responsibility for the Use of the Platform

The User is solely responsible for any use contrary to this Terms, for any infringements that may be incurred or for any damage that may be caused by the use of the Service, and SAFF, its group companies and Affiliate, collaborators, employees and representatives are exonerated from any kind of liability that may arise from the User's actions.

SAFF will use all reasonable efforts and means to provide up-to-date and reliable information on the Service; however, SAFF does not assume any guarantee in relation to the absence of errors, or possible inaccuracies and/or omissions in any of the content accessible through the Service.

The User is solely liable for any claim or legal action, judicial or extrajudicial, brought by third parties against SAFF based on the User's use of the Service. Where applicable, the User will assume all expenses, costs and indemnities incurred by SAFF as a result of such claims or legal actions.

Within the limits established by applicable legislation, SAFF excludes all liability that may arise from interferences, omissions, interruptions, computer viruses, telephone breakdowns or disconnections in the operation of the electronic system, due to causes beyond the control of SAFF.

Likewise, SAFF also excludes any liability that may arise from delays or blockages in the operation of this electronic system caused by deficiencies or overloading of telephone lines or the Internet, as well as damage caused by third parties through illegitimate interference beyond the control of SAFF.

SAFF is entitled to temporarily suspend, without prior notice, access to the Service for maintenance, repairs, updates or improvements.

In the event that this page may contain links to other portals or sites not managed by SAFF, SAFF declares that it has no control over such sites and is not responsible for their content. The links that the Service may contain are offered as informative references, without any type of assessment of the contents, owners, services or products offered therein.

In any case, SAFF is exonerated from all liability in relation to the services provided by said third parties against any claims of any nature and lawsuits that may be filed in relation to the same.

Intellectual Property Rights

All the content of the Service, unless otherwise indicated, are either the exclusive property of SAFF has all the rights necessary for the provision of the Service and is fully authorised by its owners, including but not limited to the graphic design, source code, logos, texts, graphics, illustrations, photographs and other elements that appear in the Service. Likewise, all trade names, trademarks or distinctive signs of any kind contained in the Service are protected by law.

SAFF do not grant any type of licence or authorisation for personal use to the User over its intellectual property rights or over any other right related to the Service.

Therefore, the User acknowledges that the reproduction, distribution, commercialisation, transformation and, in general, any other form of exploitation, by any means, of all or part of the content of the Service constitutes an infringement of the intellectual property rights of SAFF or of the owner of the same.

The User, solely and exclusively, may use the material that appears on this site the Service for their personal and private use, being prohibited its use for commercial purposes or to engage in illegal activities.

The reproduction, distribution and public communication, including making available, of all or part of the contents of the Service, for commercial purposes, in any medium and by any technical means, without the authorisation of SAFF, are expressly prohibited without the authorisation of SAFF. The User undertakes to respect the intellectual property rights owned by SAFF.

Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions. Upon termination, your right to use the Service will cease immediately.

Limitation of Liability

Notwithstanding any damages that You might incur, the entire liability of SAFF and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service or SAR100 if You haven't purchased anything through the Service.

To the maximum extent permitted by applicable law, in no event shall SAFF or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if SAFF or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

"AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, SAFF, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, SAFF provides no warranty or undertaking, and makes no representation of any kind that the Service will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

Without limiting the foregoing, neither SAFF nor any of SAFF's provider makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Service, or the information, content, and materials or products included thereon; (ii) that the Service will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the Service; or (iv) that the Service, its servers, the content, or e-mails sent from or on behalf of SAFF are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.

Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to You. But in such a case the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.

Governing Law

The laws of the Country, excluding its conflicts of law rules, shall govern this Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.

Disputes Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting SAFF.

Assignment

SAFF may transfer, subcontract or otherwise deal with its rights and/or obligations under this Terms without notifying or obtaining the User's consent. The User may not transfer, subcontract or otherwise deal with its rights and/or obligations under this Terms.

Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.

Translation Interpretation

These Terms and Conditions may have been translated if We have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute.

Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.

By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Service.
